There is good news and bad news in yesterday’s SCOTUS ruling on the CDC’s eviction moratorium. The good news is that a majority of the Court agreed on the merits with the stay applicants, the Alabama Association of Realtors, that the moratorium was unlawful. As Justice Kavanaugh put it, “the Centers for Disease Control and Prevention exceeded its existing statutory authority by issuing a nationwide eviction moratorium,” and “clear and specific congressional authorization (via new legislation) would be necessary for the CDC to extend the moratorium past July 31.”
